Listing Data:

• Listing views, bookmarks, and status flags
• Timestamps of interactions

Device Data:

• Device location (when you grant permission)
• Device type and operating system (collected by the app platform)

3. Legal Basis for Processing (GDPR Article 6)

• Contract performance (Art. 6(1)(b)): Processing your account and listing data to provide the service.

6. International Data Transfers

Your data may be transferred to and processed in the United States through our service providers. These transfers are protected by the EU-US Data Privacy Framework and Standard Contractual Clauses where applicable.

• Listings expire automatically after 7 days.
• Account data is retained for as long as your account is active.
• Anonymized analytics data may be retained indefinitely.
• Upon account deletion, your personal data will be removed. Anonymized data may persist.

9. Cookies and Local Storage

The App uses local device storage (AsyncStorage) to maintain your login session. This is necessary for the App to function and does not involve third-party tracking cookies.

10. Children's Privacy

The App is not intended for children under 16 years of age. We do not knowingly collect personal data from children under 16.

11. Photos and Images

• Images you upload are stored on Supabase servers.
• Images may contain personally identifiable information (faces, locations, license plates). Consider this before uploading.
• Images are accessible to other users viewing your listings.
• Images are deleted when you delete a listing.

We may update this Privacy Policy from time to time. We will notify you of significant changes through the App or via email.

Terms of Service

1. Acceptance of Terms

By accessing or using the Free The Stuff application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Free The Stuff is a community platform that allows users to post and discover free items in their local area. The App enables users to create listings, browse items on an interactive map, and connect with others to give away or pick up free items.

3. User Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years of age to use this App.
• You may not create multiple accounts or transfer your account to another person.

4. User-Generated Content

You are solely responsible for the content you post, including listings, images, descriptions, and location data.

• You grant Free The Stuff a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the App and its promotion.
• You agree that Free The Stuff may use your posts for marketing purposes.
• You agree that other users may share your listings or published information, including on third-party platforms such as social media.

5. Accuracy of Information

Free The Stuff relies on user-submitted data. Not all information may be accurate, complete, or up to date. Free The Stuff does not verify the accuracy, quality, safety, or legality of listed items.

6. Location Accuracy and Safety

Location information, including pins, markers, and addresses, should be used as approximate references only and not as absolute or precise locations.

If a listing location appears to be in a dangerous or inaccessible place — including but not limited to streets, bodies of water, train tracks, construction sites, or private property — do not attempt to seek the listing. Report it immediately.

You are solely responsible for your personal safety when retrieving or delivering items. Free The Stuff assumes no liability for injuries, damages, or losses that occur during the exchange of items.

7. Data Usage and Analytics

You agree that we may use your anonymized posting data for generating statistics and reports, including but not limited to media, text, and location data.

No personally identifiable information will be intentionally associated with this data collection. However, images you upload may contain identifiable information (faces, license plates, etc.). You should consider this before posting.

8. Third-Party Services

Authentication and data storage services are provided by Supabase. By using the App, you acknowledge that your login credentials and listing data are processed by Supabase in accordance with their privacy policy.

Map services are provided by Google Maps. The use of these third-party services is subject to their respective terms and privacy policies.

9. Communications

• Account-related emails (account creation, password reset) are sent via third-party email services to ensure functionality of your account.
• Free The Stuff may send you emails regarding your account and the service.
• With your consent, Free The Stuff may send you promotional or marketing emails.
• You may enable or disable marketing emails at any time within the App.

10. Prohibited Conduct

You agree not to:

• Post illegal, hazardous, or prohibited items
• Post false, misleading, or fraudulent listings
• Harass, threaten, or abuse other users
• Attempt to circumvent any security features of the App
• Use the App for commercial purposes without authorization

11. Account Suspension and Termination

Abuse or violation of these Terms may result in account suspension or termination without prior notice. Free The Stuff reserves the right to remove any content that violates these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, Free The Stuff and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to personal injury, property damage, or loss of data.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the jurisdiction of the courts in Berlin, Germany.
